Terms of Service

These Terms of Service ("Terms") govern your access to and use of MécanoFlow ("the Service"), a shop management platform for independent auto repair shops, operated from Ottawa, Ontario, Canada ("MécanoFlow", "we", "us"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the shop you represent.
1. The Service
MécanoFlow provides tools for estimates, invoicing, work orders, appointment scheduling, digital inspections, customer communications (SMS and email), reporting, and related shop management features. Features available to you depend on your subscription plan. AI-generated estimates and repair guidance are decision-support tools only — final pricing, diagnosis, and repair decisions are the shop's responsibility.
2. Accounts and Responsibilities
- You must provide accurate information when registering and keep it current.
- You are responsible for safeguarding account credentials and for all activity under your shop's accounts, including team members you invite.
- You must be authorized to act on behalf of the shop you register.
- Notify us immediately of any unauthorized access at support@mecanoflow.ca.
3. Subscription and Billing
- Plans are billed monthly or yearly in Canadian dollars (CAD), in advance, plus applicable taxes (GST/HST/QST based on your province).
- Payments are processed by Stripe. We do not store card numbers.
- Plans renew automatically until cancelled. You may cancel at any time; the subscription remains active until the end of the paid period. Fees already paid are non-refundable except where required by law.
- We may change pricing with at least 30 days' notice; changes apply from your next renewal.
- Usage limits (users, AI requests, SMS volume) apply per plan. We may throttle or require an upgrade when limits are exceeded.
4. Acceptable Use
You agree not to:
- Use the Service to send spam or messages without required consent;
- Upload unlawful, infringing, or malicious content;
- Attempt to access other shops' data or probe, scan, or test the vulnerability of the Service;
- Resell, sublicense, or white-label the Service without a written agreement;
- Use the Service to build a competing product.
5. Your Data
- You own your data. Customer records, vehicles, estimates, invoices, and related content you enter belong to your shop.
- You can export your data (CSV) at any time from Settings.
- You grant us a limited licence to host, process, and transmit your data solely to operate and improve the Service.
- You are the data controller for your customers' personal information; we process it on your behalf as described in our Privacy Policy.
6. SMS, Email, and CASL Compliance
- Messages sent through MécanoFlow are sent by your shop, in your shop's name. You are the sender for the purposes of Canada's Anti-Spam Legislation (CASL).
- You are responsible for having appropriate consent (express or implied) before messaging customers, and for honouring opt-outs. MécanoFlow provides consent tracking and automatic STOP handling to assist, but compliance remains your responsibility.
- Carrier and telephone charges for SMS delivery may apply per your plan.
7. Availability and Support
The Service is provided "as is" and "as available." We aim for high availability but do not guarantee uninterrupted operation. Planned maintenance will be communicated in advance where practical. Support is provided by email during business hours (Eastern Time), with response targets based on your plan.
8. Limitation of Liability
To the maximum extent permitted by law: (a) MécanoFlow is not liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, or business interruption; (b) our total aggregate liability for any claim arising out of the Service is limited to the fees you paid us in the twelve (12) months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including under Quebec consumer protection legislation where it applies.
9. Termination and Data Retention
- You may cancel your subscription at any time from Settings or by contacting support.
- We may suspend or terminate accounts that materially breach these Terms, with notice where reasonable.
- After account closure, you have a 30-day window to export your data. After that, data is deleted per the retention schedule in our Privacy Policy.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Disputes will be resolved in the courts of Ottawa, Ontario, except where applicable consumer law grants you the right to proceed in your home province.
11. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
